What Is A CPAP?
If you have sleep apnea, you may stop breathing at night due to airway blockages. A continuous positive airway pressure machine (CPAP) allows you to breathe more easily at night. Sadly, although these devices are meant to be safe and help you get a good night’s rest, defective CPAP machines can also cause a variety of health issues.
Why Was There A Safety Recall?
A medical device recall was issued in 2021 for CPAP and BiPAP machines manufactured by Philips Respironics. Over 3.5 million machines were recalled. The recall was issued due to a foam in the equipment, known as PE-PUR sound abatement foam, breaking down and causing various dangerous illnesses when toxins were inhaled.
Although some people can see the foam broken down in their machines as black particles, many others can not. Many people to continue to use their CPAP machines while unknowingly exposing themselves to harmful chemicals for years.
CPAP Device Injuries
Inhaling these toxic chemicals as you sleep can not only lead to short-term damage, such as symptoms you might feel as you wake up, but also long-term damage such as continued sleep apnea and increased risk of strokes, heart attacks, and cancer.
- Kidney Disease
- Liver Disease
- CPAP Cancers (Lung, Kidney & Liver Cancers)
- Respiratory Failure
- Pulmonary Fibrosis
- Heart Attacks
- Strokes
Why Are There Philips CPAP Lawsuits?
Evidence suggests that the makers of these defective sleep apnea machines, known as Phillips, knew about the risk of the foam and did nothing to recall their products until June 2021. Because Phillips admitted their products were defective but failed to act, more product liability and Phillips CPAP lawsuits are now being issued.
Should I Participate In The Class Action Lawsuit?
You can qualify for compensation and should have a strong case against Phillips if you meet certain criteria. One of the criteria is if you have used one of their recalled machines every night for 6 months or more and have now been with a lung disorder like pulmonary fibrosis.
If you have been diagnosed with a more serious condition such as lung, kidney, or liver cancer, you can also be a participant in the class action lawsuit.
